General process overview

IDR and ADR: two different processes.

This page offers general orientation. It does not describe or evaluate any owner’s particular dispute.

IDR: the Association’s internal process

Obtain the Association’s current IDR procedure from its annual policy statement or management. A written request should identify your concern and the outcome you are requesting.

Members are not charged a participation fee for the IDR process. Any attorney or other assistance you choose may be at your own expense. Follow the Association’s procedure concerning the Board’s representative and scheduling.

ADR: an independent neutral

Mediation is a process in which a neutral helps the parties explore a voluntary resolution. Before participating, confirm the mediator, scope, fees, cost allocation, and applicable confidentiality terms.

Alternative Resolution Center publishes information about its low-cost mediation programs. Eligibility, availability, and current charges must be confirmed directly with the provider.

Check the requirements for your own matter

Whether a statutory ADR prerequisite applies depends on the type of action and relief requested. IDR or a mediation request should not be assumed to suspend payments or legal deadlines. Get individual advice before relying on a procedure to preserve a claim.
