CANTRICE COURT CONDOMINIUM OWNERS’ ASSOCIATION

PETITION FOR SPECIAL MEETING OF THE MEMBERS
RECALL AND REMOVAL OF THE ENTIRE BOARD OF DIRECTORS

TO: Board of Directors, Cantrice Court Condominium Owners’ Association

Pursuant to the Association’s Bylaws, California Corporations Code sections 7510, 7511, and 7222, and the applicable election provisions of the Davis-Stirling Common Interest Development Act, the undersigned members hereby request a special meeting of the membership for the purpose of voting on the recall and removal of the entire Board of Directors and, if the recall succeeds, electing replacement directors.

1. RECALL OF ENTIRE BOARD

Whether the membership approves the recall and removal from office of the entire Board of Directors of Cantrice Court Condominium Owners’ Association then serving at the time of the recall election.

2. ELECTION OF REPLACEMENT DIRECTORS

If the recall is approved, the membership shall elect qualified replacement directors to fill the resulting vacancies in accordance with California law, the Association’s governing documents, and the Association’s lawful election rules.

FORMAL DEMAND

1. Accept this petition as a written request satisfying the Association Bylaws’ requirement for signatures by members representing at least five percent (5%) of the Association’s total voting power and California Corporations Code section 7510(e), which permits a special meeting to be called by five percent (5%) or more of the members.
2. Fix and give notice of the special membership meeting and recall election within the time required by California law.
3. Conduct the recall election and any election of replacement directors in accordance with applicable California law and the Association’s governing documents and election rules.
4. Use a duly appointed independent inspector of elections as required by law.
5. Provide all legally required notices concerning the recall election, replacement-candidate nominations, voting procedures, ballot deadlines, meeting date, quorum requirements, and election procedures.
6. Permit eligible members to nominate qualified replacement candidates in accordance with applicable law and the governing documents.
7. Prepare and distribute the legally required secret ballots and election materials.
8. Preserve this petition and election-related records as required by law.

This petition requests one special membership meeting and election process addressing the recall of the entire Board and the election of replacement directors if the recall succeeds.

The undersigned expressly reserve all rights available under California law and the Association’s governing documents.

Each signer represents that the signer is a member entitled to execute this petition with respect to the identified separate interest.
