The dispute concerns whether the contemporaneous records clearly establish the amounts, approval, notice, and supporting documentation for the 2025 reserve-payback assessment and the separate 2026 $300 assessment. Those issues have not been adjudicated.

The ballot fixes the owner assessment at $1,999,999.60. Board materials describe expected roof cost at approximately $1.6 million and state that additional amounts address cost growth, contingencies, and reserves if unused. The material question is how the fixed assessment amount was calculated and reconciles with the project and financing records.
The record should show the current property-insurance structure clearly.
The recorded governing documents contain a 100% replacement-cost insurance requirement. Board materials have discussed alternative approaches to that requirement. The open issue is whether the current declarations, limits, layers, attachment points, deductibles, exclusions, and valuation support can be reconciled with the governing documents.

The pending small-claims case concerns Association records, meeting materials, insurance information, and assessment-related records. The Association's August 28 filing publicly states that the parties were proceeding to mediation.
